What Is Erb’s Palsy, And What Causes It?

Erb’s palsy is a brachial plexus injury that causes weakness in the shoulder or arm. The brachial plexus is a group of five nerves that connect the arm and hand to the spine, allowing the shoulder, arms, and hands to move and feel. When the upper nerves are damaged, it results in Erb’s palsy.

One of the injuries that most commonly leads to the development of Erb’s palsy is avulsion, which is when the nerve rips away from the spine. Rupture is another type of injury in which a nerve rips but not from the spine.

A neuroma is another kind of injury leading to Erb’s palsy, and it’s when the nerve tears and heals but leaves scar tissue. The fourth kind of injury is neurapraxia, which occurs when the nerve stretches but doesn’t tear.

Newborns can develop Erb’s palsy during a vaginal or C-section birth. In some cases, the healthcare provider has to move the baby’s head aside to make room for the delivery of the shoulders. This can stretch the nerves and lead to tears.

Up to two of every 1,000 babies sustain a brachial plexus birth palsy. Although many babies go on to recover from this injury, some require surgery.

Erb’s palsy is often the result of a healthcare provider who didn’t respond to a difficult birth properly or quickly enough. It can occur under many different circumstances as well.

Understanding Liability in Florida Medical Malpractice Cases

Each year in Florida, there are approximately 1,700 medical malpractice cases filed. Malpractice laws assess liability by examining whether the doctor or other healthcare provider breached their duty of care to the patient, resulting in damages. It’s up to the plaintiff to prove that the provider’s negligence led to the injury.

One of the concerns people have when filing a medical malpractice claim involves consent forms. For example, in Erb’s palsy cases that occurred during a C-section, the mother might have signed a consent form before going into surgery. However, this doesn’t necessarily bar the success of your claim.

You can pursue both economic and non-economic damages through a medical malpractice claim. Economic damages include financial losses, like medical bills. Non-economic damages include pain and suffering and other less easily quantifiable aspects of the injury.

Because Florida medical malpractice laws are complex, the right thing to do if your child has Erb’s palsy because of medical error during birth is to turn to an experienced attorney.
