What Is a Self-Driving Car?

Although there is a great deal of buzz around self-driving cars, fully autonomous vehicles are not currently available for consumer use. Even cars promoted as “fully self-driving,” such as Teslas, typically require some level of human participation and oversight.

The following five levels of automation have been identified by the Society of Automotive Engineers:

Level 0

These vehicles have no automation beyond alerts when you veer off-lane or when you are about to back into something. While these cars may have cruise control, this must be manually operated, and steering and speed are controlled by human drivers.

Level 1

Level 1 vehicles help the driver with either speed or steering. Some also include adaptive or dynamic cruise control that will slow the car if it gets too close to a leading vehicle.

Level 2

Level 2 vehicles can control steering and can accelerate or brake as needed. They also include sensors to help maintain lanes and cruise control. These systems may deactivate after a certain point if hands are not sensed on the steering wheel. Drivers of level two vehicles must remain alert and aware of their surroundings.

Level 3

Level 3 vehicles can observe the environment, control steering and speed, and notify drivers to take control if necessary.

Level 4

Level 4 vehicles have the highest degree of automation. In certain conditions, they are able to drive without any human assistance. This is typically the case at certain speed limits or within geofencing zones. Level 4 vehicles can assume control if a system breaks down, but generally speaking, human supervision is still a must.

Level 5

Level 5 vehicles are completely autonomous and can drive in any conditions with zero human control or oversight.

Who Is Liable for a Self-Driving Car Accident in Fort Lauderdale, FL?

Determining liability involves first identifying the cause of the accident and then tracing it back to who was responsible for the cause.

The entities below could be held accountable in a self-driving car accident:

  • Drivers
  • Negligent pedestrians or bicyclists
  • Vehicle manufacturer
  • Manufacturer of automation technology
  • Government agencies responsible for infrastructure laws

Identifying the cause of the accident, such as driver negligence, improper regulations, or defective automation technology, can easily get quite complex. Having an attorney who is well-versed in autonomous vehicles can make all the difference in the outcome of your case.
