The United States government issues more defective product recalls to companies deemed to be marketing dangerous or deadly product than any country in the world except China.

In 2009, the U.S. Consumer Product Safety Commission obtained 465 voluntary recalls of products it deemed unsafe, pulling more than 230 million units from store shelves nationwide.

Building a successful product liability case requires an extensive investigation and the legal and financial resources to tackle some of the nation’s wealthiest companies. At the Hollander Law Firm, our reputation for handling such complex cases has allowed us to forge relationships with some of the nation’s leading experts in the field and to hire the engineers and other experts critical to successfully building such complex cases.

Dangerous, deadly or defective products can be found in all industries and are the result of a variety of causes:

  • Serious injury or death from a defective product can be the result of poor design and manufacturing or can be the result of after-market alterations made by distributors, retailers or current or previous owners.

  • Unclear instructions and the lack of prominent warning labels may leave a consumer open to injury.

  • Medical products are sometimes found to be defective because of inadequate research and development, or even because a company put profits before safety in either knowingly marketing a questionable product or failing to diligently investigate a product before rushing it to market. Prescription drugs with deadly side effects, faulty joint replacements and poorly designed defibrillators and pace makers are all examples of dangerous or deadly products, which have been marketed to consumers.

  • The automobile industry is a notorious offender responsible for some of the largest recalls in U.S. history. In 2010, high-profile recalls involving Toyota resulted in the recall of more than 8 million defective vehicles for serious safety hazards, including sticking gas pedals and faulty brakes. Not even its vehicles marketed as luxury automobiles made the grade; Consumer Reports slapped Lexus’ GX 460, part of Toyota’s flagship luxury line, with a “Don’t Buy” rating because of handling problems that could result in rollover during sharp turns. Only then did the company issue a recall.

The number of vehicles recalled in the United States has skyrocketed, from 8.4 million in 1993 to more than 16.4 million in 2009, according to the U.S. Transportation Safety Administration.
